Penalties for DUI in RI
DUI-related penalties in RI are strict and include:
- First DUI—up to 1 year in jail, $100 to $500 in fines, and up to 18 month’s license suspension
- Second DUI—10 days to 1 year in jail, $400 to $1,000 in fines, and up to 2 year’s suspension
- Third DUI—1 to 5 years in jail, $400 to $5,000 in fines, and at least 2 year’s suspension
- First Breath Test Refusal--$200 to $500 in fines, and 10 to 60 hours community service
- First DUI under 21—10 to 60 hours community service, and 6 to 18 months suspended license
- First DUI with 0.15% BAC or more—$500 fine, up to 1 year in jail, and up to 18 months suspension
RI has a “lookback” period of five years, meaning all previous convictions within this time will be taken into account with subsequent charges.
