How Does an Ignition Interlock Device Work?
The IID is connected directly to the ignition. The driver is required to provide a breath sample. If the device detects any alcohol in the driver’s system, then the car will not start. The driver will also need to provide breath samples at intervals during the trip. The results of each test, as well, will also be logged. The judge and caseworkers can review these results at any given time, and will usually do so periodically.
Qualifications for an Ignition Interlock System
Being required to install an ignition interlock system on a driver’s vehicle depends on the charge. Those who are eligible include first-time DUI offenders with a BAC between .08% and .15%, as well as a first-time chemical test refusal offense.
However, the laws in RI impose the installation of the IID on the following:
- habitual offenders or whose blood-alcohol content was twice above the legal limit
- those who had a BAC level of .15% or above on their first-time DUI offense
- those who committed their second or third chemical test refusal offense
While an ignition interlock system appears to be another form of penalty, having an this type of system installed in your vehicle enables your attorney to pursue a reduced license suspension and/or a hardship license, which enables a driver to operate their motor vehicle for the limited purpose of getting to and from work during their suspension.
