Punishment for Larceny in Rhode Island
Under Rhode Island law, the consequences for a larceny arrest can depend on the value of the property, the kind of property stolen, or the manner in which the property is stolen. These penalties are serious and can often result in permanent criminal records, jail time, or fines. If you are charged with a larceny crime, whether it is a misdemeanor or felony, it is essential that your hire competent counsel.
For example, for you could face the following charges:
- Larceny of $1,500 or less: A misdemeanor, up to 1 year of jail time, fines of up to $500, and restitution.
- Larceny of more than $1,500 or a gun: A felony, not less than 1 year up to 10 years in prison, fines of up to $5,000, and restitution.
- Larceny from the person: A felony, up to 10 years in prison, and possible fines.
The same penalties apply for attempted acts of larceny that end in failure. A person can be arrested for attempted larceny if they take steps towards the commission of the larceny but ultimately are unable to take possession of another's property.
There are also unique penalties for stealing property from a minor or senior:
- Stealing from a person under 18 years: Up to 10 years in prison and up to $500 in fines.
- Stealing over $500 from a person 65+ years old: Between 2 to 15 years in prison and up to $5,000 in fines.
- Stealing $500 or less from a person 65+ years old: 1 to 5 years in prison and up to $3,000 in fines.
