Rhode Island Marijuana Penalties
In Rhode Island, marijuana charges are largely broken down into six different categories: possession of less than an ounce of marijuana, possession of over an ounce of marijuana, manufacturing marijuana, possession with intent to deliver marijuana, unlawful delivery of marijuana, and cultivation of marijuana. The severity of these charges can vary based on the circumstances of the crime, such as where it took place, how much of the substance was involved, and whether or not any weapons were present.
In RI, the penalties for marijuana charges can include:
- Possession under an ounce: non-criminal offense punishable by $150 ticket
- Possession over an ounce: up to 1 year in prison and $500 in fines
- Possession with intent: up to 30 years in prison and $100,000 in fines
- Manufacturing: up to 30 years in prison and $100,000 in fines
- Unlawful delivery: up to 30 years in prison and $100,000 in fines
- Cultivation: up to 30 years in prison and $100,000 in fines
In the case of possession, subsequent offenses can increase the severity of the charge. For manufacture and sale charges, the involvement of minors or school zones will also be cause for harsher penalties.
