Penalties for Boating Under the Influence in RI
Similar to a DUI offense, Rhode Island law sets the blood alcohol content (BAC) limit for boating while intoxicated at 0.08% or greater. BUI is considered a civil offense under Rhode Island law if a person's BAC is between .08% and .1%. Upon an admission to a BUI with readings between .08% and .1%, a person could be punished by a fine of up to $250, face up to 60 hours of community service, 45-day suspension from operating a watercraft, and enroll in a boating safety course.
However, if the offender’s BAC limit was .1% or more, they may face misdemeanor charges in addition to the penalties listed above. A misdemeanor conviction includes a maximum jail sentence of a year.
